New York is proposing to amend its New York Medicaid Redesign Team
section 1115 demonstration. The state is requesting section 1115 authority
to apply federal transfer of assets rules to certain categories of people
applying for community based long term care (CBLTC) services. Under
federal law, the lookback period is 60 months prior to the month an
individual applies for Medicaid; however, New York is applying for a
waiver to utilize a shorter lookback period of 30 months for non-institutionalized
individuals who are looking for coverage of CBLTC services. The federal
public comment period will be open from April 9, 2021 through May 9, 2020.
