my world - Charon - 01-19-2025

my landlord is an attorney. and likes to get his way. i have paid the rent on time every month. and the 495 for heat

so today he told me those big guys are coming back to throw out dennis and my stuff.

is that eviction? my neighbor said i should say i shall call the police.

i have followed every rule. i have paid the rent on time. the heat bill on time.

has anyone heard of this before?

No they can't throw your belongings out.

You don't even have to have a lease to live there. If no lease then court or cops default to basic real estate law. If you're belongings are inside a property it's assumed an agreement was made for you to live there.

If your landlord wants you out he has to server you with a 30 day notice and depending on what state might need a good excuse to do so.

If you receive a 30 day try paying the rent still. If he cashes the check the notice may be void and he'll have to file another. Same goes with a 3 day pay or quit notice.

ny and thank u so much

This might not help in your situation but if you get down to the wire and there are no judgements against you then you can file for bankruptcy and this will put a temporary stay. It might take several months to file having to get all the documents and waiting on court which would give you more time.
It would not be the best option if your not in a financial situation and probably not the best advise out there.

in most states, unless you get a formal 30 day notice from the landlord they can't make you leave even if your name is not on the lease. I would call legal aide too find what your rights are as a tenant in NY.

dennis did not have the funds but he was just about to get his social security the month he died.

he was finally deemed permanently disabled due to breathing i suppose.

i got mine in 2012. i am just permanently disabled no hope of recorvery.

off to dry my hair and put on makeup.
